Terms and Conditions for Using POS at TechFusion Solutions
Please read these Terms and Conditions ("Agreement") carefully before using the Point of Sale (POS) system provided by TechFusion Solutions. This Agreement sets forth the terms and conditions governing your use of the POS system.
1. Acceptance of Terms
By accessing or using the POS system, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must refrain from using the POS system.
2. License
TechFusion Solutions grants you a non-exclusive, non-transferable license to use the POS system solely for the purpose of processing transactions and managing sales at your business premises. This license is revocable at any time without prior notice or liability.
3. User Account
To use the POS system, you may be required to create a user account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to promptly notify TechFusion Solutions of any unauthorized use of your account or any other breach of security.
4. Hardware and Software
You are responsible for providing and maintaining the necessary hardware and software required to access and use the POS system. TechFusion Solutions does not guarantee compatibility of the POS system with all devices and operating systems.
5. Data and Privacy
TechFusion Solutions may collect and store certain data related to your use of the POS system, including transaction details and customer information. By using the POS system, you consent to the collection, storage, and processing of such data in accordance with TechFusion Solutions' Privacy Policy.
6. Intellectual Property
The POS system, including all related software, documentation, and materials, is the exclusive property of TechFusion Solutions or its licensors. You acknowledge and agree that all intellectual property rights in the POS system are protected by applicable laws and treaties.
7. Prohibited Activities
You agree not to use the POS system for any unlawful or prohibited purpose. Prohibited activities include, but are not limited to:
a. Violating any applicable laws or regulations.
b. Interfering with or disrupting the operation of the POS system.
c. Accessing or attempting to access the accounts or data of other users.
d. Engaging in any fraudulent or deceptive activities.
8. Limitation of Liability
To the maximum extent permitted by law, TechFusion Solutions shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the POS system, even if TechFusion Solutions has been advised of the possibility of such damages.
9. Modifications to the Agreement
TechFusion Solutions reserves the right to modify this Agreement at any time without prior notice. Any modifications will be effective immediately upon posting of the revised Agreement. Your continued use of the POS system after the posting of any modifications constitutes your acceptance of the modified Agreement.
10. Termination
TechFusion Solutions may terminate your access to the POS system at any time without prior notice or liability. Upon termination, all licenses and rights granted to you under this Agreement will immediately cease.
11. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where TechFusion Solutions operates. Any legal action or proceeding arising out of or relating to this Agreement shall be exclusively settled in the competent courts of that jurisdiction.
12. Entire Agreement
This Agreement constitutes the entire agreement between you and TechFusion Solutions regarding the use of the POS system and supersedes all prior agreements and understandings, whether oral or written.
By using the POS system, you signify your acceptance of these Terms and Conditions.
